1. Agreement to These Terms
These Terms and Conditions (the “Terms”) govern your registration for, purchase of tickets to, sponsorship of, and attendance at AgencyCon (the “Conference” or “Event”), a conference produced by Hyper Dog Media (“AgencyCon,” “we,” “us,” or “our”), and your use of the website located at https://agencycon.events/ (the “Website”).
By purchasing a ticket, registering for the Event, submitting a sponsorship or vendor application, attending the Event, or using the Website, you (“you,” “your,” “Attendee,” or “Registrant”) agree to be bound by these Terms. If you do not agree to these Terms, do not purchase a ticket, register, or attend.
If you are registering on behalf of a company, agency, or other organization, you represent that you have authority to bind that entity to these Terms, and “you” refers to both you individually and that entity.
2. Definitions
- “Event” means AgencyCon, including all sessions, workshops, panels, meals, receptions, networking functions, and ancillary activities, whether held at the primary venue or elsewhere.
- “Ticket” means any pass, registration, or credential granting access to the Event, including Early Bird, Standard, Vendor, sponsor, speaker, staff, and complimentary passes.
- “Agency Ticket” means a Ticket in the Early Bird or Standard tier, or any successor tier designated by AgencyCon as intended for agency owners, operators, and employees attending in a learning and networking capacity rather than a commercial capacity.
- “Vendor Pass” means a Ticket in the Vendor tier, which is available by approval only and is intended for entities whose participation includes a commercial, sales, recruiting, or business-development component.
- “Venue” means the facility at which the Event is held, together with its owners, operators, and staff.
- “Ticketing Platform” means Eventbrite or any other third-party service through which AgencyCon sells or distributes Tickets.
3. The Event
AgencyCon is a professional conference for digital marketing agency owners, operators, and leaders. Session content, speakers, schedule, format, and venue are subject to change. AgencyCon makes no guarantee that any particular speaker, session, topic, or activity advertised will occur as described.
Event dates, location, and program details are published on the Website and may be updated from time to time.
4. Registration and Tickets
4.1 Eligibility
AgencyCon is a business-to-business professional event. Attendees must be at least 18 years of age. Registration is intended for individuals employed by, owning, or operating digital marketing agencies and related professional service firms, and for approved sponsors and vendors.
4.2 Accuracy of Registration Information
You must provide complete and accurate information when registering, including your legal name, business email address, company name, and job title. AgencyCon may verify this information at any time. Providing false, misleading, or incomplete information is grounds for cancellation of your registration and denial of admission without refund.
4.3 Named Registrants
Each Ticket admits one named individual. Tickets may not be shared, split, or used by more than one person. Badges are non-transferable at the Event and must be worn and visible at all times while on site.
4.4 Third-Party Ticketing
Tickets are sold through the Ticketing Platform. Your purchase is additionally subject to the Ticketing Platform’s own terms of service and privacy policy. AgencyCon is not responsible for the acts, omissions, availability, or security of the Ticketing Platform. In the event of a conflict between these Terms and the Ticketing Platform’s terms with respect to the Event itself, these Terms control as between you and AgencyCon.
4.5 Unauthorized Resale
Tickets may not be resold, auctioned, offered as a prize or promotional item, or otherwise commercially exploited without AgencyCon’s prior written consent. Any Ticket obtained in violation of this section is void, and the holder may be denied admission or removed without refund.
5. AgencyCon’s Sole Discretion Over Ticket Sales and Attendee Classification
This Section 5 is a material term of these Terms.
5.1 Final Authority Over Whether a Ticket May Be Purchased
AgencyCon is the final authority on whether any person or entity may purchase a Ticket to the Event. AgencyCon reserves the right, in its sole and absolute discretion and at any time, to:
- decline, reject, or refuse any registration or Ticket purchase request, whether before or after payment is submitted;
- cancel, void, or revoke any Ticket already purchased or issued;
- limit the number of Tickets sold to any individual, agency, company, or affiliated group of companies;
- require an application, interview, verification of employment, or supporting documentation as a condition of purchase;
- impose conditions on a registration, including reclassification to a different Ticket tier; and
- refuse admission to, or remove from the Event, any Ticket holder.
AgencyCon is not required to provide a reason for any such decision. Where AgencyCon cancels or revokes a Ticket under this Section 5.1 for reasons other than your breach of these Terms, your exclusive remedy is a refund of the amount actually paid for that Ticket. Where AgencyCon cancels or revokes a Ticket as a result of your breach of these Terms, including the Code of Conduct in Section 8 or the non-solicitation obligations in Section 9, no refund will be issued.
Limitation. Nothing in this Section 5 authorizes AgencyCon to refuse a Ticket purchase or admission on the basis of race, color, religion, national origin, ancestry, sex, sexual orientation, gender identity or expression, marital status, disability, age, or any other characteristic protected by applicable federal, Colorado, or local law. AgencyCon’s discretion is exercised solely with respect to the professional, commercial, and conduct-related considerations described in these Terms.
5.2 Final Authority Over Agency Ticket Qualification Versus Sponsor or Vendor Status
AgencyCon is the final authority on whether any person or entity is qualified to purchase an Agency Ticket, or whether that person or entity must instead register as a sponsor or under a Vendor Pass.
Agency Tickets are reserved for individuals attending in a learning and peer-networking capacity on behalf of a digital marketing agency or comparable professional services firm. Vendor Passes and sponsorships are required for individuals and entities attending in a commercial capacity, including but not limited to those whose purpose or effect at the Event includes:
- marketing, promoting, demonstrating, or selling products or services to other Attendees;
- generating leads, booking sales meetings, or conducting business development;
- recruiting Attendees as employees, contractors, affiliates, resellers, or partners;
- promoting a competing conference, event, community, mastermind, or membership program; or
- conducting market research, press, or analyst activity.
In determining whether an entity qualifies for an Agency Ticket, AgencyCon may consider factors including the entity’s primary business model, its customer base, whether it sells software, platforms, tools, media, or services to agencies, its prior conduct at AgencyCon or other events, the number of individuals it seeks to register, and any other factor AgencyCon deems relevant. AgencyCon’s determination is final and binding.
If AgencyCon determines that a Registrant holding an Agency Ticket does not qualify for that tier, AgencyCon may, in its sole discretion:
- require the Registrant to upgrade to a Vendor Pass or sponsorship and pay the difference in price as a condition of admission;
- cancel the Agency Ticket and refund the amount paid; or
- cancel the Agency Ticket without refund where the Registrant misrepresented their role, employer, or purpose in attending.
A determination under this Section 5.2 may be made before the Event, at check-in, or at any time during the Event.
5.3 No Waiver
AgencyCon’s decision to admit any person or entity in a prior year, or to approve one registration, does not create any right, expectation, or precedent with respect to any other registration or any future event.
6. Pricing, Payment, and Promotional Codes
All prices are stated in U.S. dollars and exclude applicable taxes and Ticketing Platform fees unless otherwise noted. Payment is due in full at the time of purchase.
Ticket tiers, pricing, and promotional codes are available for limited periods and in limited quantities, and may be modified or withdrawn at any time. Group and other discounts are subject to the conditions published on the Website and to verification by AgencyCon.
In the event of an obvious pricing, typographical, or system error, AgencyCon reserves the right to cancel affected orders and refund amounts paid, whether or not the order has been confirmed.
7. Refunds, Transfers, and Cancellation
7.1 Refunds by Attendee
Except as otherwise stated in the refund policy published on the Website at the time of purchase, refund requests must be submitted in writing to AgencyCon before the published refund deadline. Requests received after that deadline will not be refunded, but the Ticket may be transferred in accordance with Section 7.2.
Sponsorship fees and Vendor Pass fees are non-refundable except as expressly provided in a separate written sponsorship agreement.
7.2 Transfers
Subject to Section 5, a Ticket may be transferred to another qualified individual before the Event by written notice to AgencyCon identifying the new Registrant. Transfers are subject to AgencyCon’s approval of the substitute Registrant’s eligibility under Section 5.2. Transfers are not permitted once Event check-in has begun.
7.3 Cancellation, Postponement, or Change by AgencyCon
AgencyCon may cancel, postpone, reschedule, relocate, or change the format of the Event at any time. If AgencyCon cancels the Event and does not reschedule it, AgencyCon will refund the Ticket price actually paid, less Ticketing Platform fees where those fees are non-recoverable.
If the Event is postponed, rescheduled, relocated, or converted to a different format, Tickets will be honored for the rescheduled or modified Event. AgencyCon is not obligated to issue refunds in that circumstance.
In no case is AgencyCon liable for travel, lodging, transportation, or other expenses incurred by an Attendee in connection with the Event, regardless of the reason for cancellation or change. Attendees are strongly encouraged to purchase refundable travel arrangements or travel insurance.
7.4 Force Majeure
AgencyCon is not liable for any failure or delay in performing its obligations where that failure or delay results from causes beyond its reasonable control, including acts of God, fire, flood, severe weather, natural disaster, epidemic or pandemic, public health order, act of terrorism, war, civil disturbance, labor dispute, utility or telecommunications failure, venue unavailability, or governmental action or restriction.
8. Code of Conduct
AgencyCon is committed to providing a professional, harassment-free experience for all participants.
The following conduct is prohibited at the Event and at all Event-related functions:
- harassment, intimidation, discrimination, or abusive conduct of any kind, including unwelcome sexual attention;
- verbal or physical threats, violence, or disruptive behavior;
- disparaging or demeaning conduct directed at other Attendees, speakers, sponsors, staff, or Venue personnel;
- damage to or misuse of Venue property;
- possession of weapons, illegal substances, or prohibited items;
- intoxication resulting in disruptive or unsafe behavior; and
- any conduct that violates applicable law or Venue policy.
Attendees must comply with all Venue rules, posted signage, and the reasonable directions of AgencyCon staff and Venue personnel. The Venue may impose additional requirements, and Attendees are responsible for observing them.
Violations should be reported immediately to AgencyCon staff. AgencyCon will investigate reports as it deems appropriate and may take any action it considers necessary, including warning, removal from the Event without refund, exclusion from future events, and notification of the violator’s employer or law enforcement.
9. Non-Solicitation and Commercial Activity
AgencyCon is a no-sales-pitch event. Except as expressly authorized in a written sponsorship or vendor agreement, Attendees may not:
- distribute marketing materials, samples, or promotional items;
- set up signage, displays, tables, or booths;
- conduct product demonstrations;
- host or promote competing or parallel events, parties, suites, or gatherings targeting Event Attendees during Event dates;
- scan, scrape, photograph, or otherwise systematically collect Attendee badges, contact information, or the Attendee list; or
- send unsolicited commercial communications to Attendees using information obtained at the Event.
Ordinary, mutually welcome professional conversation and exchange of contact information between Attendees is permitted and encouraged.
Violation of this Section 9 is grounds for immediate removal without refund and permanent exclusion from AgencyCon events, in addition to any other remedy available to AgencyCon.
10. Photography, Recording, and Media Release
AgencyCon and its designees may photograph, film, record, and livestream the Event. By attending, you grant AgencyCon and its designees an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, edit, publish, and distribute your name, likeness, image, voice, statements, and company affiliation as captured at the Event, in any medium now known or later developed, for promotional, marketing, editorial, and archival purposes, without further notice, approval, or compensation.
If you do not wish to be photographed or recorded, notify AgencyCon staff at check-in; AgencyCon will make reasonable efforts to accommodate the request but cannot guarantee exclusion from crowd or ambient footage.
Attendees may take photographs and short video clips for personal and social media use. Attendees may not audio- or video-record full sessions, presentations, or workshops, or livestream session content, without AgencyCon’s prior written consent.
11. Intellectual Property
All Event content, including presentations, slides, handouts, session recordings, and conference materials, together with the AgencyCon name, logos, and Website content, is the property of AgencyCon, its speakers, or its licensors and is protected by intellectual property law.
Materials provided to Attendees are licensed for the Attendee’s personal and internal business use only. Attendees may not reproduce, republish, sell, distribute, or create derivative works from Event content without prior written permission from the rights holder.
Attendees may share brief quotes, takeaways, and photographs on social media with attribution, provided doing so does not disclose material a speaker has designated as confidential or off the record.
12. Confidentiality
Certain sessions, roundtables, or discussions may be designated as confidential or subject to the Chatham House Rule. Where so designated, Attendees may share the substance of what was discussed but may not identify the speaker or any other participant, or their affiliation, without express permission.
13. Assumption of Risk
You voluntarily attend the Event and assume all risks associated with attendance, including risks of personal injury, illness, communicable disease, property loss or damage, and travel. You are responsible for your own personal property at all times. AgencyCon and the Venue are not responsible for lost, stolen, or damaged property.
14. Disclaimer of Warranties
The Event, the Website, and all Event content are provided “as is” and “as available.” To the maximum extent permitted by law, AgencyCon disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Content presented at the Event reflects the views of individual speakers and does not constitute legal, financial, tax, or other professional advice, and does not represent an endorsement by AgencyCon. Sponsors, vendors, and exhibitors are independent parties; AgencyCon does not endorse and is not responsible for their products, services, representations, or conduct.
15. Limitation of Liability
To the maximum extent permitted by applicable law, AgencyCon’s total aggregate liability to you arising out of or relating to the Event, these Terms, or your attendance, whether in contract, tort, or otherwise, shall not exceed the amount you actually paid to AgencyCon for your Ticket.
AgencyCon shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost business opportunities, lost data, or travel and lodging expenses, even if advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
16. Indemnification
You agree to indemnify, defend, and hold harmless AgencyCon, Hyper Dog Media, and their respective officers, directors, employees, contractors, agents, speakers, sponsors, and the Venue from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your attendance at the Event, your breach of these Terms, your violation of any law or third-party right, or your negligent or intentional acts or omissions.
17. Privacy and Data
AgencyCon’s collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.
By registering, you agree that AgencyCon may contact you regarding the Event and future AgencyCon events, and that your name, title, and company may appear on an attendee list made available to Attendees and sponsors. You may opt out of sponsor list sharing by written request to AgencyCon before the Event.
18. Third-Party Links and Services
The Website and Event materials may link to or rely on third-party websites and services, including the Ticketing Platform, payment processors, hotels, and sponsors. AgencyCon does not control and is not responsible for the content, policies, or practices of any third party.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Event shall be brought exclusively in the state or federal courts located in Denver County, Colorado, and you consent to the personal jurisdiction of those courts.
Before initiating any formal proceeding, you agree to first contact AgencyCon in writing and attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days.
20. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy and any separate written sponsorship or speaker agreement, constitute the entire agreement between you and AgencyCon regarding the Event and supersede all prior understandings. In the event of a conflict between these Terms and a signed sponsorship or speaker agreement, that signed agreement controls as to its subject matter.
Modification. AgencyCon may modify these Terms at any time by posting the revised Terms on the Website and updating the “Last updated” date. The Terms in effect at the time of your purchase govern that purchase, except that changes to the Code of Conduct, admission, and health and safety provisions apply immediately upon posting.
Severability. If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
No Waiver. AgencyCon’s failure to enforce any provision is not a waiver of its right to do so later.
Assignment. You may not assign these Terms or your registration without AgencyCon’s prior written consent. AgencyCon may assign these Terms freely.
Independent Parties. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and AgencyCon.
Headings. Section headings are for convenience only and do not affect interpretation.

By purchasing a Ticket, registering, or attending AgencyCon, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
